HELPFUL INFORMATION REGARDING SOCIAL SECURITY DISABILITY

Deadlines.
After your denial, you have 60 days to appeal the decision. If you fail to appeal the decision becomes final. Your chances on appeal are determined by the quality of your evidence and your knowledge of the vast amount of law and regulations governing disability claims. That is why an experienced lawyer can be a crucial factor as to whether you are awarded benefits.

About Social Security Claims.
Social Security disability claims can be filed for any worker, person, or child who expects to be off work, or who expects not to return to work for one year due to physical or mental disabilities. When we represent a client in making Social Security disability claims we can represent you beginning with the initial claim denial all the way to the United States Federal Courts of Appeals. Fees are contingent upon winning the claim for you. We will ensure careful and detailed representation for each disability client.

What is Disability?
You are considered Disabled if you are unable to work due to any medically determinable physical or mental impairment which can be expected to result in death or last for a continuous period of not less than 12 months. This can mean different things in different cases because the laws also say that you are disabled if the your impairment is so severe that you cannot perform your previous work and cannot, considering your age, education and work experience, engage in any other work. This is where our careful and detailed representation goes to work for you as we look at each and every case individually.

What are the “Listings?”
The Social Security Regulations include “Listings” describing just how severe a disease, condition or impairment must be for the Social Security Administration to consider it a disability. If your one or main condition is not severe enough to meet the guidelines provided by the Listings, you could alternatively still be considered disabled if you have several different conditions which when viewed together are sufficient to consider you disabled. Other important factors considered by the regulations are age, education, work experience and the ability to speak English.

What “Evidence” is Required?
The most important evidence is your Medical reports. The law requires the Judge to place great weight on a report by a treating physician. Such a report (which provides your history, symptoms, tests and test results, diagnosis, and prognosis) can win the case if the report shows that your condition as being as severe as required buy the Listings. Since most Doctors charge a minimum of $1,000 to appear for you at a hearing, having expert witnesses at a hearing are rare. Testimony from family or friends is not normally useful unless yours is a situation where you as the Claimant cannot describe your own problems. However, an experienced social security attorney can in many cases cut through the legal and medical jargon to obtain a report or document that meets the legal requirements of the Social Security Regulations.
